Suing question:

Since purchasing my flat in 2007 I have suffered with the vapours from the communal bin store entering my flat through gaps between the walls and through the concrete. Can I claim damages for misrepresentation and contractor negligence? The communal bin room is beneath my apartment, the foul vapours from the room permeate through the concreate floors . A fire in the bin store last year resulted in my flat completely smoked out. The freeholders and Managing agents fail to take responsibility. Can I sue for damages?

There are a few different courses of action available to you. First, if the property is less than 10 years old, you should return to the solicitors who originally acted for you and ask for details of the new home warranty when you purchased (usually an NHBC or Zurich policy). Second, you need to consider whether your surveyor ought to have advised you of this and whether they did at the time. Third, there may be actions you can take under the law of nuisance that might help you.
