Suing question:

i share land with my downstair neighbour (both are leaseholders). there is a tree on land that falls under his lease. he also has a tree that has damaged parts of the property both of us are obliged to maintain (communal path). i have written to him to remedy this and to the managing agents. both have ignored my requests. what can i do next?

The first port of call must be your insurance policy or the block policy covering the building. If the damage has been cause by subsidence then this is usually a matter for one or other insurance company to sort out. If you are uncertain who covers the property press your managing agents for the answer and make sure the claim gets dealt with quickly.
